对于看守所不予收押的，意见第七条规定，“人民检察院认为理由不成立的，应当分别向公安机关、看守所出具书面意见。公安机关再次送交时，看守所应当收押。”对于监狱不予收监的，意见第九条规定，“人民检察院认为理由不成立的，应当分别向公安机关、监狱出具书面意见。公安机关再次送交时，监狱应当收监。”意见实施以来，全国检察机关相关业务部门及时了解掌握收押、收监情况，依法开展监督工作，边工作、边调研和解决问题，一批审前未羁押判处实刑的罪犯被依法收押收监交付执行。
第四十六条 本法第四十五条的规定不影响承运人在本章规定的承运人责任和义务之外，增加其责任和义务。
